Acts of Indecency


An ‘Act of Indecency’ means any act of a sexual nature with, or towards, another person that falls short of touching or penetration. It is an act which the reasonable person would consider to be contrary to community standards of decency.

What are the penalties for Act of Indecency?


The offence of Act of Indecency is contained under s 61N of the Crimes Act and applies to situations where a person commits the act themselves or where they incite a person to commit the act in question. The offence carries a maximum penalty of eighteen months imprisonment. If the victim is under 16 years of age, the maximum penalty is two years imprisonment.

Aggravated Sexual Assault


“Aggravated Sexual Assault” has a maximum penalty of 20 years whilst “Aggravated Sexual Assault in Company” has a maximum penalty of life imprisonment.

Sexual assault is an offence that would usually (but not always) result in full time imprisonment if a person is convicted. This is true even where a person has no previous convictions.

The offence of Sexual Assault is contained in section 61I of the Crimes Act 1900 which states:

Any person who has sexual intercourse with another person without the consent of the other person and who knows that the other person does not consent to the sexual intercourse is liable to imprisonment for 14 years.

In other words, this means:

  • Sexual intercourse
  • Without the other person’s consent
  • Knowing the other person does not consent


Sexual Assault


In NSW, “Sexual Assault” carries a maximum penalty of 14 years imprisonment. “Aggravated Sexual Assault” has a maximum penalty of 20 years whilst “Aggravated Sexual Assault in Company” has a maximum penalty of life imprisonment.

In NSW, a court can impose any of the following penalties for a sexual assault charge.

  • Prison sentence
  • Home Detention
  • Intensive corrections order (previously periodic detention)
  • Suspended sentence
  • Community service order (CSO)
  • Good behaviour bond
  • Fine
